At Capy LLC ("Capy," "we," "us," or "our"), we respect your privacy and are committed to being transparent about how we collect, use, share, and protect your information. This Privacy Policy applies to information we collect through yourcapy.com (the "Site"), our marketing communications (including email and text messages), and our customer service channels.
This policy is intended for residents of the United States. Capy does not knowingly serve customers outside the U.S.
1. Information We Collect
We collect the following categories of personal information:
- Identifiers: Name, shipping and billing address, email address, IP address, phone number, and (if you create an account) account credentials.
- Commercial Information: Order history, products purchased, returns and exchanges, store credit and gift card balances, and product preferences.
- Internet and Device Activity: Pages viewed, clicks, time on site, referring URLs, browser type, device identifiers, and similar data collected via cookies, pixels, SDKs, and session-recording tools (including Microsoft Clarity).
- Approximate Geolocation Data: City- or region-level location inferred from your IP address. We do not collect precise GPS location.
- Communications Data: Messages you send us through email, SMS, contact forms, customer support tickets, or product reviews.
- Survey and Quiz Responses: Answers you provide through our style quiz, surveys, giveaways, or promotions.
- Inferences: Profiles reflecting your preferences, characteristics, and predicted interests, used for marketing personalization.
- Hashed Identifiers: We may convert your email or phone number into a "hashed" (one-way encrypted) format to match with advertising partners like Google and Meta for "Enhanced Conversions" and "Customer Match."
Sources. We collect this information directly from you (when you order, sign up, contact us, or submit a review), automatically from your device as you use the Site, and from the service providers and advertising platforms listed in Section 5.
Sensitive personal information. We do not collect government identifiers, biometric data, precise geolocation, health information, or financial account details. Payment information is handled directly by Shopify Payments and PCI-compliant payment processors and is not retained by us. If you create an account, we collect login credentials, which some state laws treat as sensitive personal information; we use them only to authenticate you and operate your account, and never for advertising, profiling, or inference.
We do not ask for, and do not want, information about your health, your patients, or your employer's operations. Please do not include that kind of information in reviews, photos, or messages to us.
2. How We Collect Information
We collect information when you:
- Visit or browse the Site
- Place an order or initiate checkout
- Create an account
- Sign up for our email list, SMS list, or back-in-stock notifications
- Take our style quiz or participate in surveys, giveaways, or promotions
- Join our ambassador or referral program
- Request a return, exchange, or store credit
- Contact customer support
- Submit a product review
- Interact with our ads on third-party platforms
We also automatically collect information through cookies, web beacons, pixels, SDKs, tag managers, and similar tracking technologies. This includes server-side tracking (such as Meta Conversions API and Google Enhanced Conversions), where event data is transmitted directly from our servers to advertising partners.
3. How We Use Your Information
We use your information to:
- Process and fulfill orders, including order confirmations and shipping updates
- Process returns, exchanges, refunds, and store credit
- Provide customer support
- Send marketing communications (with your consent where required)
- Send abandoned cart reminders by email and/or text message (see Section 6 for SMS-specific details)
- Administer our ambassador, referral, and gift card programs
- Personalize your shopping experience and product recommendations
- Measure and improve the performance of our marketing
- Detect, prevent, and address fraud, payment disputes, abuse, or security incidents
- Comply with legal and regulatory obligations
We do not use your personal information to make automated decisions that produce legal or similarly significant effects about you.
4. How We Use Information About Healthcare Employment
Many of our customers work in healthcare. We may know or infer that you work in a healthcare setting — from what you buy, from a review you write, or from a form you fill out. That is information about your occupation, not about your health. We do not collect, infer, or process information about your own physical or mental health status, diagnoses, treatments, medications, or healthcare you have sought or received, and we do not use any such information for advertising or profiling.
5. How We Share Your Information
We share information with the following categories of third parties:
- Service providers that operate our business, under contracts that limit them to processing information on our behalf. These currently include Shopify (e-commerce platform, checkout, and payments), Klaviyo (email and SMS marketing), Gorgias (customer support), Judge.me (product reviews), ReturnZap (returns and exchanges portal), BixGrow (ambassador and referral program), Google (tag management and analytics), and Microsoft Clarity (analytics and session recording).
- Advertising partners including Meta (Facebook/Instagram), Google, and TikTok, with whom we share hashed identifiers and event data to measure advertising performance and deliver targeted advertising. Under California, Virginia, Colorado, and similar state privacy laws, this activity may be considered "sharing" or "selling" personal information for targeted advertising.
- Shopify Network: We participate in the Shopify Network, which uses interaction data to provide business insights to us and other Shopify merchants.
- Legal and safety purposes: Where required by law, subpoena, court order, or to protect our legal rights, property, or the safety of our customers. This includes providing order and delivery records to payment processors and card networks in response to a payment dispute or chargeback you initiate.
- Business transfers: In connection with a merger, acquisition, financing, or sale of assets.
Which categories go where. Identifiers and commercial information go to our service providers and, in a payment dispute, to payment networks. Internet and device activity, approximate geolocation, inferences, and hashed identifiers go to our analytics and advertising partners. Communications data goes to our support, review, and marketing platforms. We do not disclose account credentials to anyone.
The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties for their own marketing purposes.
We do not sell personal information for money. Our use of advertising cookies and hashed identifiers may qualify as a "sale" or "share" under certain U.S. state laws. See Section 11 for opt-out instructions.
6. Text Message (SMS) Marketing
If you opt in to receive text messages from Capy, the following applies:
How we collect your phone number: You may provide your phone number at checkout, through sign-up forms on our Site, through back-in-stock notification forms, or through other promotions. Providing your number and opting in constitutes your express written consent to receive recurring marketing and transactional text messages from Capy at the number provided, including messages sent using an automatic telephone dialing system. Consent is not a condition of any purchase.
What we send: Order confirmations, shipping updates, abandoned cart reminders, back-in-stock alerts, promotional offers, new product launches, and other marketing messages.
Abandoned cart text messages: Capy LLC's website uses cookies to help keep track of items you put into your shopping cart, including when you have abandoned your cart. This information is used to determine when to send cart reminder messages by text message.
Message frequency: Message frequency varies based on your activity and our promotional calendar. Message and data rates may apply.
How to opt out: You can opt out of marketing text messages at any time by replying STOP to any text we send. For assistance, reply HELP or contact us at the email address in Section 19. Opting out of marketing texts will not affect transactional messages related to orders you have placed.
Carrier disclaimer: Carriers are not liable for delayed or undelivered messages. Supported carriers include all major U.S. wireless carriers.
No third-party sharing: As noted in Section 5, your text message opt-in information and consent will not be shared with any third parties for their own marketing purposes.
7. Cookies, Tracking, and Session Recording
We use the following categories of cookies and similar tracking technologies on our Site:
- Strictly necessary cookies required to operate the Site, including cart, checkout, and security functions.
- Analytics cookies that help us understand how visitors interact with the Site (e.g., Microsoft Clarity, Shopify analytics, Google Analytics).
- Marketing and advertising cookies that allow us and our partners to deliver relevant advertising and measure its effectiveness (e.g., Meta Pixel, Google Ads tags, TikTok Pixel).
Session recording. We use Microsoft Clarity, a third-party analytics service, to record how visitors interact with the Site — including mouse movements, clicks, scrolling, and pages viewed — so that we can find and fix usability problems. By using the Site, you consent to this recording and to Microsoft's processing of that data as a service provider to us. Payment fields and other sensitive form inputs are masked and are not captured. We do not use session recordings to listen to audio, access your camera, or read content outside our Site. You can prevent session recording by blocking analytics cookies in your browser or through the opt-out resources in Section 11.
Do Not Track. Some browsers send a "Do Not Track" (DNT) signal. There is no common industry standard for how to respond to DNT, and our Site does not respond to DNT signals. We do respond to Global Privacy Control (GPC) signals where we are able to detect them, as described in Section 11.
You can manage cookies through your browser settings or by using the opt-out resources listed in Section 11.
8. Location Information
We collect approximate, IP-based location data to estimate the city or region you are visiting from. This is used for analytics, fraud prevention, sales tax determination, and shipping calculations. We do not collect precise GPS location, and we do not use mobile location-based services.
9. Notice of Financial Incentive
We offer a discount on your first order when you sign up for our email and/or SMS marketing lists. Because this discount is offered in exchange for your personal information, some state laws treat it as a "financial incentive," and we are required to describe it to you.
- What we collect: Your email address, and your phone number if you opt in to SMS.
- What you get: The discount stated on the sign-up form at the time you subscribe (currently 15% off your first order), plus marketing messages about new products and promotions.
- How to join: Enter your email address and/or phone number in a sign-up form on the Site and confirm your subscription.
- How to withdraw: Unsubscribe from any marketing email, or reply STOP to any marketing text. Withdrawing ends the incentive; discounts already applied to a completed order are not affected.
- How we value your information: We calculate the value of your information as approximately equal to the cost of the discount we provide — that is, the discount amount applied to a first order. We use this good-faith method because we do not otherwise assign a monetary value to any individual's personal information, and we do not sell personal information for money.
- Why the incentive is permitted: The value of the discount is reasonably related to the value your information provides to us through the marketing relationship it creates. Declining to subscribe does not affect the price you pay, the products available to you, or the level of service you receive.
10. Data Retention
We retain your personal information only for as long as necessary to fulfill the purposes outlined in this policy, to comply with our legal, accounting, and tax obligations (typically up to 7 years for order and financial records), to resolve disputes, and to enforce our agreements. Marketing data is retained until you opt out or after a period of prolonged inactivity, whichever comes first. Session recordings are retained for the period set by our analytics provider, which does not exceed 90 days.
11. Your Privacy Rights and Choices
Depending on your state of residence, you may have some or all of the following rights regarding your personal information:
- Right to know / access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the third parties we share it with.
- Right to delete personal information we have collected from you (subject to certain exceptions).
- Right to correct inaccurate personal information.
- Right to data portability in a usable, machine-readable format.
- Right to opt out of "sale" or "sharing" of personal information and the use of personal information for targeted advertising.
- Right to opt out of profiling that produces legal or similarly significant effects.
- Right to non-discrimination for exercising your privacy rights.
These rights are available to residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Florida, Montana, Iowa, Tennessee, Indiana, Delaware, New Hampshire, Maryland, Nebraska, Kentucky, Rhode Island, New Jersey, and Minnesota. We extend them to residents of any other state whose comprehensive privacy law takes effect after the date of this policy.
To exercise any of these rights: Email us at hello@yourcapy.com with the subject line "Privacy Request," or write to us at the mailing address in Section 19. Tell us which right you are exercising and the email address or order number associated with your purchases so we can locate your information. We may need to verify your identity before fulfilling your request, and we will not use information you provide for verification for any other purpose. You may designate an authorized agent to submit a request on your behalf; we may ask the agent for proof of your written authorization.
How long we take: We will confirm receipt of your request within 10 business days and respond substantively within 45 days. If we need more time, we will tell you within the first 45 days and may take up to 45 additional days.
If we deny your request — appeals: If we decline to act on your request, we will tell you why. You may appeal that decision within 60 days by replying to our response or emailing hello@yourcapy.com with the subject line "Privacy Appeal." We will respond to your appeal in writing within 45 days, explaining the reasons for our decision. If your appeal is denied, you may contact your state Attorney General to submit a complaint; we will provide a link or contact details for doing so with our appeal response.
To opt out of targeted advertising and "sale" or "sharing":
- Email us at hello@yourcapy.com with the subject line "Do Not Sell or Share My Personal Information."
- Global Privacy Control (GPC): Where we are able to detect a browser-based GPC signal, we treat it as a valid request to opt out of "sharing" and targeted advertising for the browser or device sending the signal.
- Industry-wide opt-out: Digital Advertising Alliance WebChoices Tool.
- Shopify Network: Manage your data within the Shopify ecosystem at the Shopify Privacy Portal.
- Platform controls: Meta Ad Preferences and Google Ad Settings.
To opt out of marketing communications:
- Email: Click the "unsubscribe" link at the bottom of any marketing email, or update preferences at the link provided.
- SMS: Reply STOP to any marketing text message.
12. Washington Consumers
We are a Washington business. We do not collect "consumer health data" as defined by the Washington My Health My Data Act. We do not infer, record, or share information about your health conditions, treatments, medications, or healthcare services sought or received, and we do not use any such information for advertising. See Section 4.
13. Data Security
We implement industry-standard administrative, technical, and physical safeguards designed to protect your personal information, including encryption in transit, access controls limiting who at Capy can view customer records, and reliance on PCI-compliant processors for all payment handling. However, no method of transmission over the Internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
14. Children's Privacy
Our Site is not directed at children, and our products are sold only to adults 18 and over. We do not knowingly collect personal information from children under 16, and we do not knowingly collect personal information from children under 13 as defined by the Children's Online Privacy Protection Act. We do not "sell" or "share" the personal information of consumers we know to be under 16 for targeted advertising purposes. If you are a parent or guardian and believe we have collected information from your child, please contact us at the address in Section 19 and we will promptly delete it.
15. Third-Party Links
Our Site may contain links to third-party websites and services, including our ambassador portal and returns portal, which are operated by third parties under their own privacy policies. We are not responsible for the privacy practices of those sites, and we encourage you to review their privacy policies before providing any information.
16. United States Only
Capy serves customers in the United States only. Our Site, products, and services are intended for U.S. residents and are not directed at residents of the European Economic Area or the United Kingdom. Your information will be processed and stored in the United States and may be accessed by service providers located in other jurisdictions for the limited purposes described in this policy.
17. Reviews and Content You Post Publicly
When you submit a product review, photo, or video, the content you submit — along with the name or initials you choose to display — is published publicly on our Site and may be used in our marketing, as described in our Terms of Service. Do not include information in a review that you do not want to be public. If you want a published review removed, email us at hello@yourcapy.com.
18. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last Updated" date at the top reflects the most recent revision. Material changes will be communicated through prominent notice on the Site and, where appropriate, by email.
